Uttar Pradesh Government Imposes ESMA

Uttar Pradesh government has imposed Essential Services Maintenance Act (ESMA) in the state. The order released in this regard says that the act will be imposed for 6 months.

As per the U.P ESMA, the state government now has the power to prohibit strikes in workplaces for the next six months, after which it may be extended for another six months. Last time the act was imposed in the state on 22nd May this year and the time period of six months has expired. WHEREAS the State Government is satisfied that it is necessary and expedient in the public interest so to do;

NOW, THEREFORE, in exercise of the powers under sub section of section-3 of the Uttar Pradesh Essential Services Maintenance Act, 1966 (U.P. Act No.30 of 1966) the Governor is pleased to prohibit, for a period of six months from the date of publication of this notification in the Gazette, strikes in –

a) any public service in connection with the affairs of the State of Uttar Pradesh;
b) any service under a corporation owned or controlled by the State Government and any service under a local authority.
